Malaysia’s income tax system is based on a territorial principle. This means that both resident and non-resident companies are taxed on income derived from within Malaysia, while income of resident companies from abroad is exempt from tax. However, this exemption does not apply to businesses in banking, insurance, and maritime and air transport.
A company, whether a tax resident or not, is assessed on income generated in Malaysia or received from abroad. A company is considered a Malaysian tax resident if its management and control are exercised in Malaysia.
