Malaysian Employment Pass (EP)

The Malaysian Employment Pass (EP) is a work permit that allows foreigners to work legally in Malaysia. The validity of this visa can be up to 60 months, depending on your employment contract and the decision of the Expatriate Committee (EC). Before receiving approval from the Malaysian Immigration Department, you must first obtain recognition from the Expatriate Committee or the relevant authorities

Applicants must meet specific conditions to apply for a Malaysian Employment Pass, including:

  • Applicants must be at least 27 years old (except in the IT industry, where applicants must be at least 23 years old)
  • Applicants must hold a valid passport with a minimum validity of 18 months

EP Type I

Applicants must earn a minimum monthly salary of at least RM 10,000 and have an employment contract of at least 5 years or more

EP Type II

Applicants must earn a monthly salary of at least RM 5,000 to RM 9,999 and have an employment contract of at least 2 years.

EP Type III

Applicants must earn a monthly salary of at least RM 3,000 to RM 4,999 and have an employment contract of no more than 12 months

Companies regulated by approval or regulatory bodies must submit approval letters from the relevant authorities for all types of Employment Passes

Note: The company must ensure that it holds all valid licenses and approvals required for company registration

Depending on the applicant’s occupation, the applicant’s employer must apply for the foreign position through one of the government-approved agencies listed below:

  • Malaysian Investment Development Authority (MIDA) for manufacturing and service industries
  • Malaysian Digital Economy Corporation (MDEC) for the technology sector
  • Bank Negara Malaysia (BNM) for the financial sector
  • Biotech and bio-based industries through the Bioeconomy Corporation
  • Securities Commission (SC) for the securities and futures market sector
  • Expatriate Committee (EC) (operating under the Malaysian Immigration Department) for all other industries

Once the Expatriate Committee or other authorized agency approves the employer’s application, the employer can proceed to apply for the Employment Pass

Industries not allowed to apply for Employment Passes

According to the “Guidelines on Foreign Participation in the Distributive Trade Services Malaysia,” the following industries are not allowed to apply for Employment Passes:

  1. Supermarkets/mini-markets (with a sales area of less than 3,000 square meters)
  2. Supply stores/general suppliers
  3. Convenience stores (operating 24 hours)
  4. Newsagents and grocery stores
  5. Medical clinics (favoring traditional alternative medicine and general dry goods)
  6. Gas stations with convenience stores
  7. Gas stations without convenience stores
  8. Permanent wet market shops
  9. Permanent roadside shops
  10. National strategic interests
  11. Textiles, restaurants (non-exclusive), pubs, jewelry stores
  12. Other

Application timeline

After obtaining all relevant authorities’ approvals, the applicant can begin the EP/EEP application process. This may take up to 2 weeks (14 days) for processing. Please note that if the provided application materials are incomplete, the processing time may extend to 3 months or longer.

2. Submit the application online
3. Immigration Department processes the application
4. Notification of application status
5. Company setup

Apply for a Malaysian work visa

  1. Review documents: Check company and applicant documents to ensure they meet application requirements
  2. Collect documents: Prepare all necessary documents and proof for the application.
  3. Pay registration fee: Pay the registration fee after submitting the application online.
  4. Upload documents: Upload documents to the application website.
  5. Apply for entry visa: After receiving the approval documents, go to the Malaysian embassy to apply for the visa.
  6. Prepare to go to Malaysia: Book a flight to Malaysia.
  7. Submit immigration sticker: After arrival, submit to the immigration office to get the work visa sticker.
  8. Start work: Begin working once the visa is effective.
